After months of waiting, we can announce the results of the Centre for Quantum Technologies/New Scientist Quantum Shorts film competition.
Our illustrious panel of judges was blown away by the quality of the shortlisted films. Ben Bowie, twice-Emmy-nominated producer of Discovery Channel?s Stephen Hawking?s Universe and creative director at Darlow Smithson Productions, was impressed by the variety of submissions. ?I think it?s safe to say each and every film has something special,? he said.
Quantum physicist Artur Ekert, the director of the Centre for Quantum Technologies, said the brief of the competition made it a real challenge. "Given that the subject matter is difficult I thought it was an interesting collection to watch."
We asked the judges to rate their top three films, and from this we have a winner and runner-up. In addition, we asked you to vote for your favourite: the People?s Choice.
First prize of 2000 Singapore dollars (just over ?1000) goes to the animation Quantum Daughter, an astonishing snapshot of life in a future where we can travel between different universes. Lisa Randall, Harvard University professor of theoretical physics and author of Knocking on Heaven?s Door, acclaimed it as easily her favourite. ?It?s clever, creative, had some of the physics and is funny,? she said. Ariane Koek, who leads the arts-science programme at CERN, near Geneva, Switzerland, also marked it as a favourite, calling it ?original, quirky and funny, as well as technically good?.
For the runners-up prize, the judges showed an even split, with no way of choosing between two films. So, the prize of 1000 Singapore dollars (just over ?500) is shared between Alice in Quantumland and Heisenberg.
Alice in Quantumland uses the quantum trick of existing in more than one place to open up a romantic opportunity. This, according to Lonce Wyse, director of the Arts and Creativity Lab in the Interactive and Digital Media Institute at the National University of Singapore, had ?good cinematography and a rich connection to various aspects of quantum theory?. Jeremy Webb, editor-in-chief of New Scientist, liked the fact that you don't need to understand quantum theory to follow the plot. ?I think it introduces people to some funky quantum effects in an intriguing, humorous, enjoyable way,? he said.
Heisenberg?s cheeky dialogue tickled many of the judges. ?It?s pretty funny,? Randall said. Bowie agreed. ?It?s funny and sexy,? he said. ?Who?d have thought that was possible in a film about quantum physics??
All the judges agreed that it wasn?t easy picking out winners from such a strong field. ?I am really impressed that quantum theory can inspire such creativity,? said Webb. ?I would like to congratulate all the directors on their imaginations and the skill with which they have told their stories?.
And the People?s Choice? Well, hundreds of you voted, and Alice in Quantumland came out on top, with quantum thriller the Cat coming a close second.

Microsoft (MSFT) announced Monday it will begin selling its Surface Pro tablets to consumers on Feb. 9.
The Surface Pro tablet will retail for $899. It offers a faster processor and greater power than its sister Surface RT tablet (which sells for half the price). Microsoft entered the tablet market in October 2012 ? about 2.5 years after Apple (AAPL) debuted its iPad.
Microsoft will report sales of its tablets on Thursday when the Seattle-based company releases fourth-quarter earnings. According to Wall Street estimates, sales may be lackluster.
UBS analyst Brent Thill told The New York Times he slashed his Q4 Surface sales forecast by half; he?s now expecting sales to total 1 million, down from 2 million. In comparison, Apple reported last November that it sold 3 million fourth-generation iPads in three days after the product?s launch.

Microsoft definitely faces an uphill battle in the tablet market. Consumers can choose from a diverse array of tablets including Barnes & Noble?s (BKS) Nook, Amazon?s (AMZN) Kindle, the HP (HPQ) Envy, the Archos 101 G9, Acer Iconia Tab, Samsung Galaxy, Blackberry Playbook (RIMM) and the Google (GOOG) Nexus 7.
Josh Brown, vice president of Fusion Analytics and author of the widely read ?The Reformed Broker? blog, says Microsoft has no business being in the hardware business.
?The public is not clamoring for a Microsoft products,? he says in an interview with The Daily Ticker. ?I don?t know if the Surface launch accomplished anything other than ?hey we?re in this business now.??
Brown advises against owning shares of Microsoft and says only a leadership change at the upper echelon of the Microsoft corporate ladder ? including the departure of CEO Steve Ballmer ? would be the catalyst to push the stock higher.

Reports that Microsoft may provide capital for a deal that would take computer maker Dell (DELL) private could be seen as a veiled attempt by Microsoft to boost sales of its Windows operating platform. CHARLOTTE, N.C. (AP) ? Republican soul-searching begins in earnest this week as GOP officials from every state in the nation come together for the first time since their party's November shellacking.
There is broad agreement that the Republican Party needs to undergo fundamental changes to remain competitive as surging minority populations re-shape the American electorate. But there is no clear path forward. And even as they gather in a Charlotte, N.C., hotel this week ? just days after President Barack Obama began his second term ? Republicans are in some ways as divided as ever.
Facing his first re-election test later in the week, Republican National Committee Chairman Reince Preibus is under intense pressure to improve the Republican brand to attract more women and Hispanics, while not upsetting the hard-line conservatives who represent his party's most passionate voters.
"They're really going to have to do full throttle self-examination. They have alienated so many people who are Republicans," said Olympia Snowe, a three-term Republican senator who retired last year, in part because of her party's shift to the right. "It's going to be a mighty challenge. The party's gone astray."
Indeed, the formal theme of the Republican National Committee's winter meeting ? "Renew, Grow, Win" ? reflects an understanding from party officials that the GOP must grow to survive. In particular, this week's meeting will focus on the need to abandon harsh rhetoric on illegal immigration, women's issues and the social safety net, rhetoric that helped drive moderate voters and minorities toward Democrats last fall.
"We need to renew our values, renew our party, renew what we stand for," RNC spokesman Sean Spicer said.
The push to broaden the party's message is the focus, but not the only business on the agenda for the three-day meeting in North Carolina, a presidential swing state where Democrats hosted their national convention last summer.
Republicans from across the nation will decide Friday whether Priebus deserves a second term after his party lost an opportunity to win the White House and add Senate seats under what appeared to be favorable political conditions. The 40-year-old Wisconsin native is widely expected to win re-election, despite a challenge from Maine National Committeeman Mark Willis, a former Ron Paul supporter who led a brief revolt at the party's national convention last year in Tampa, Fla.
Willis said Wednesday that he did not have the backing of three states needed to ensure a spot on the ballot with Priebus. He acknowledged that he would not likely defeat the sitting chairman even if he qualifies for the ballot. But he and others lashed out at party leaders, saying they were marginalizing grassroots supporters who favored presidential candidates like Paul, former Pennsylvania Sen. Rick Santorum, Minnesota Rep. Michele Bachmann or Kentucky Sen. Rand Paul, who is thought to have interest in a 2016 presidential bid.
Former House Speaker Newt Gingrich, a conservative favorite, is attending the meeting in an unofficial capacity. Louisiana Gov. Bobby Jindal, who has been mentioned as a possible 2016 presidential candidate, will deliver a keynote address Thursday night.
Ongoing discussions are expected to swirl about the 2016 presidential voting calendar, which sets the first contests for Iowa, New Hampshire, South Carolina and Nevada. While no shifts are expected this week, some party officials have grown increasingly concerned about Iowa's role after its last presidential caucus.
The results were confusing at best. Mitt Romney, who eventually won the nomination, was initially declared the caucus winner by the Iowa GOP. A subsequent tally, however, suggested that Santorum actually won by a handful of votes.
Some Republicans complain that Iowa's socially conservative voters tend to support candidates that represent ideological extremes. Santorum's candidacy was driven in large part by his opposition to abortion rights and gay marriage. Four years earlier, Iowa Republicans favored Mike Huckabee, a former Arkansas governor and ordained Baptist minister who went on to win just a handful of states.
"I think Iowa is where all eyes are focused," said veteran GOP operative Phil Musser.
But Republicans far from Iowa also hurt their cause in the last election cycle.
Romney helped alienate many Hispanic voters by highlighting his support for a fence along the Mexican border and "self-deportation" of illegal immigrants. Down-ticket Republican candidates alienated female voters by backing new abortion laws in a handful of swing states like Virginia and New Hampshire, while Senate candidate Todd Akin of Missouri hurt himself and his party by declaring that women's bodies could prevent pregnancy in cases of "legitimate rape."
Exit polls make clear that Republicans face an uphill battle if they hope to repair their image.
Obama dramatically outperformed Romney among Hispanics last fall, winning 71 percent of the growing demographic compared to Romney's 27 percent. That was the GOP's worst showing among Hispanics since 1996, according to exit polling collected by The Associated Press. It was worse among black voters, who supported Obama over Romney 93 percent to 6 percent.
The disparity is less acute among women ? Obama captured 53 percent of the female vote ? although two decades have passed since a Republican presidential candidate last hit the 50-percent mark with women.
This week marks the beginning of a substantive discussion, but Priebus has outlined plans to release a "Growth and Opportunity Effort" later in the spring that offers specific paths forward.
It's unlikely to satisfy everyone.
"There's too many people that are either in the Republican Party wondering why they are in the Republican Party because they feel like the party isn't representing them any longer," said Nevada Republican national committeewoman Diana Orrock, a former Paul supporter who worries that grassroots supporters are being taken for granted. "Or we have people who have left the Republican Party and aren't getting a clear message as to why they should come back into the fold."
"We're losing elections," she said. "Something has to change."

The Internet Isn?t Making Us Sad Any More Than TV Is Making Us Fat
Saying that social sharing sites show the ?best of the world? is like saying television only shows the Hollywood dream version of reality. The Web is like a realtime sample of humanity; it?s all the emotions at once. Joy. Rage. Empathy. A LOT of Schadenfreude. For years, Facebook?s killer feature was a complete accounting of all the people who didn?t like me in high school.
The Internet isn?t making us sad any more than television is making us fat, or cellphones are giving us short attentions spans. I?m wearing my heart on my sleeve here, but I believe it?s the most powerful force for innovation and creation in human history ? a series of tubes that simultaneously made the world smaller and bigger than we ever thought possible, while giving us the ability to reach out without ever leaving our homes. The next round of dramatic innovations will be about making that power portable, ubiquitous, and sharing it with the next 2 billion people who?ve never experienced it.
Is the Internet making us sad? The only despair I feel is for those who might never realize that the Web is so much more than tweets and reblogs: that we can get under the hood and make it whatever we want.

The Only Person Who Can Sabotage My Happiness Is Myself
I barely use Pinterest, but I?m a Facebook freak. I practically live on Facebook, both personally and professionally. If it?s possible to be clinically addicted to it, well, I probably am. Most of my personal Facebook status updates are sickeningly upbeat and maybe even a little cocky (?I just published this article here.? ?Off to the dojo to spar.? ?I just ran X miles in X minutes.?). Fine, they?re mostly cocky, which is probably super annoying to anyone whose newsfeed I status bomb up to four or five times a day. I use Facebook to gather career cred and contacts (a la LinkedIn), but mostly to interact with former classmates, friends, and family? and several dozen strangers whom I?m not even sure why I friended. I try stay mainly positive on my FB wall, but switch it up with whiny updates from the downer side of life (?Up all night with hurling kiddos again.? ?Blew a red light and totaled my car.? ?Can?t believe some dude fell asleep during my speech.?).
Despite studies that show the more people (and especially women) use Facebook, the lower their self-esteem dips, I still get a reassuring thrill out of learning what my 1,502 ?friends? are up to every day, basically all day. Facebook is a one-stop gossip shop that makes it fast and easy for me to lurk on lots of people?s lives. Trolling everyone?s probably at least somewhat inflated status updates keeps me feeling connected to a larger community, which makes me happy, not sad. And, yes, sometimes a little jealous, too, especially when I see that a fellow writer published a book (a longtime goal I have yet to achieve). But that?s just life ? life reflected on Facebook.
There will always be haves and have nots, on Facebook and off. Some of my friends, family members, and colleagues will do more, be more, and have more than me, in real-life and on Facebook. Before Facebook, people paraded their life?s achievements and possessions via annual Christmas cards and letters, family vacation photo albums, grandparent brag books, narcissistic blogs, and countless other means of ego on display. No matter what my so-called ?friends? are bragging and buzzing about on Facebook, the only person who can sabotage my happiness is myself.

The Medium is Not the Cause
I?ve read about the Stanford research on how social media can make people sad, but I think it?s misguided. Proper casual usage is a joy and connects us with old friends we would otherwise lose touch with. It provides more social access and opportunity than we might have otherwise, and it makes keeping in touch more efficient.
Do people abuse Facebook and make themselves sad? Okay. But it?s the medium not the cause. I don?t think companies need to say ? don?t spend your entire life on our site. Obsessive types may just find something else to obsess about. There?s a difference between a product that?s directly responsible for causing ill health ? like lead paint ? and a product that amplifies already existing conditions, like jealousy or low self esteem.

Strangers Are Just Family You Have Yet to Come to Know
It?s a big world out there and with the fast pace of social media, we can use it for entertainment, social good, advertising, networking?the list is almost neverending. It?s true that many people, myself included, want to put their best face forward whether it is online through social media, or in person at a business function or social event. As long as we are honest and resist embellishing the truth, we can use the medium for fun, and even use its power to do good. I?ve used Twitter to help out with fundraising and have seen others use it very successfully for campaigns.

On Facebook, I sometimes post photos of beautiful and exotic places as destinations on my travel wish list. I may not be able to visit to Rio de Janeiro or Bora Bora today or tomorrow, but it?s on my list, and posting it on Facebook opens conversations with friends and people from across the world. Some of us may not be able to check off every destination we?ve hoped of visiting in our lifetime, but there isn?t anything wrong with a little daydreaming?in fact, it can give us the inspiration to achieve goals.
I try to keep my social media pages positive and informative, and feature beautiful visual images for an interesting diversion. We as individuals need to take responsibility for our own social media pages just as much as the big companies do. I was very happy to see an article on The Guardian UK?s website about five social media applications that are doing what they can to foster development, growth and empowerment across the globe. For instance, Rwanda?s health minister, Dr. Agnes Binagwaho (@agnesbinagwaho) opens a dialogue on Twitter every Monday so that citizens can talk directly to their government. Catapult is the first crowdfunding platform aimed at women and girls that allows supporters to track the progress of their donations. It may be small steps, but they are definitely in the right direction.
True contentment comes from within?as they say, money can?t buy love or happiness. And you probably can?t buy it through Pinterest either. But if we all do our part and try to stay positive, social media surely can be used as a way to support the greater good.

Balance Is The Key
If you only live your life online and through other people, you?re probably going to be disappointed and unhappy at some point. Online networks and platforms are not a substitute for real, live and in person interaction with people. Pinterest, Facebook and other social platforms are tools you can use to share your experiences with other people and begin to develop relationships. They are not meant as a vehicle to live someone?s else?s life.
Balance is the key for anyone who is active on social networks; balance between online and offline interaction. Social media sites are not happiness sabotagers in and of themselves; rather, it?s the user?s reaction and interpretation of their own experience using these networks which determines whether it affects their level of happiness.
People that constantly live their lives through the experiences of others (or alleged experiences as not everything someone posts online is necessarily true,) are doomed to feel their lives are not as exciting or happy as others they observe on social media. You create your own happiness through your own experiences. It?s up to you to make the decision to take action to make your desires a reality. Only then can you be really truly happy.

People Behave Similarly Online and Off
In this context, it could be argued that TV, magazines and movies have always been happiness sabotagers. Sites like Facebook and Pinterest are just new versions of the same antics. However, if we dig into how traditional media and social media are different, there may be something to this.
With TV and traditional media, we observe strangers living an above average quality of life, however, with social media we observe people we actually know living (what seems to be) an above average quality of life. If there?s cause for concern, it?s that. The perceived happiness of people we know probably impacts our own happiness much more than the perceived happiness of a stranger. For example, it?s easier to say, ?That?s not real life,? to something we see on TV vs. something posted online by someone we know.
If there is sabotage at work, here?s one way to deal with it from a non-happiness crushing perspective: the way people behave online is similar to the way they behave in-real-life. People will always put their best self forward, whether it?s online or when they doll themselves up for a night on the town. Everybody wants to look his or her personal best.
If we consider that when looking at how awesome everyone is through Facebook and Pinterest, we can put our friends? delusions of grandeur in perspective and not let it cripple our own happiness.

Stop Living Life Through Social Media
Every year there is a new social media platform to try ? some stick and some fall. But as users spend more and more time with social media, their lives become more dependent and intertwined with their favorite mediums. This goes beyond the common (and frankly pathetic) practice of broadcasting your entire life via social media, the ?look at me? mentality has now spread across multiple generations, morphing into a user base that lives their life through social media. Early critics of social media warned this would occur, and recommended the medium be used as a convenient extension of real-life human interaction, augmenting personal and professional relationships. Unfortunately for our society that is not what happened. So now we have an inflated issue of the grass is greener effect thanks to instant access to the successes and failures of our social media circles.
For people who choose to remain offline hermits but online extroverts, social media will always be a source of despair. But for those who choose to interact with a healthier mindset, platforms like Facebook and my personal favorite ? Pinterest ? are a source of creative inspiration, contributing to important and meaningful conversations based on personal interests, and maintaining long distance relationships.
Regarding businesses? place in this ?live your life online? society, they can only benefit. The more time people spend online as a happy or miserable human being, the more opportunity brands and businesses have to reach and engage them. Today?s users are looking to social media to guide them toward all they can aspire to be, and businesses to should provide them with that type of content. For example ? real estate agent should include fun, viral content such as ?the 10 most beautiful homes in New York City? alongside their own listings and any blog content, because they gain far greater attention as obsessed pinners pass the link and images around. Beyond convenience or education, businesses can benefit by catering to the changing emotional state of their social media audience.
It is simply not the responsibility of your local travel agent, or the folks at TOMS, to educate today?s users on how to live a happier life with social media. This is the job of our education system, parents, and any users with a shred of self-awareness. But that is a very different conversation of course.
Which are the major Cyprus laws in respect to Will and Succession?
The succession law in Cyprus is regulated by:
?? The Wills and Succession Law, Cap 195 which regulates the law in respect to wills and succession which was enacted in 1945 and since then it has undergone only 2 amendments. It is a composite edition of the English, the Ottoman and the Italian?Law.
?? The Administration of Estates Law, Cap 189 which regulates the procedure regarding the evidence and the execution of wills and the administration of the estate of the deceased.
?? The Probates (Re-Sealing) Law, Cap 192 which is applicable in cases where the deceased passed away in UK or in another Commonwealth country and at the time of his death he had property in Cyprus. Specifically, Cap 192 regulates the procedure by which the Cyprus Courts re-seal the Letters of Administration or the Grant of Probate which was issued by courts in UK or in any Commonwealth country and an administrator is appointed for the estate of the deceased located in Cyprus.
How is it determined whether Cyprus law is the applicable law in each case?
In order to decide as to whether the Cyprus law is to regulate the will/legacy of the deceased, it has to be determined whether the deceased was domiciled in Cyprus at the time of his death. ?Domicile? is a broad concept but in strictly speaking terms it may be defined as the place the deceased person considered as his permanent residence and where he had an ample intention to spend the rest of his life. There are two kinds of domicile, the domicile of origin and the domicile of choice. The domicile of origin is the place where the deceased was born. The testator adopts a domicile of choice if he moves to another place and he adopts the domicile of that place. However, until he adopts the domicile of choice, he is considered to still possess the domicile of his origin. A person is only allowed to have one domicile at a time. Once the domicile of the deceased has been determined, then his legacy must be classified into immovable and movable property as they are treated differently by Law.??Immovable property? has been defined in the same way it is defined in The Immovable?Property Law, CAP 224 which includes, land, buildings, trees, sources, trusts, easements etc. ?Movable property? includes any other property which does not fall under the category of immovable property.
According to section 5 of CAP 195, and the case Kochino v Irfan (1976) 1 CLR 240, irrespective of whether the person has a Cypriot domicile, Cyprus Law:
??does not regulate any immovable property which is situated outside Cyprus;
?regulates the immovable property which is situated in Cyprus irrespective of where the domicile of the deceased is found;
?? regulates all the movable property anywhere in the world of the deceased who has a Cypriot domicile.
According to section 12 cap 195, succession to movable property of a deceased whose death took place in Cyprus but has another country?s domicile, will be regulated by the country?s law who has its domicile. Also, it must be noted that the applicable law which regulates the will of the testator is the Law which is in force at the time of his death.
How an individual may distribute his estate?
According to section 21 of Cap 195, a person may distribute his estate in two ways:
According to the law of succession, or
??By drafting a will. A will is a written legal declaration expressing the wishes of the testator regarding the distribution of his estate after his death.
However, it must be emphasized that a testator?s whole estate cannot be distributed solely according to his will. Restrictions are imposed by section 41(1) of Cap 195 on testators in distributing their estate, i.e. ?the disposable portion? verified at the day of his death when he has a spouse or children. The rest of his estate, the statutory portion, will be distributed according to Law. The principle regarding the concept of statutory portion is that a substantial part of the estate must be reserved for the closed relatives of the deceased. The rules of the statutory portion are also applicable in cases where there is no will or in cases where a part of the estate is not included in the will.?In cases where the testator distributes more than the disposable portion he is allowed to distribute, then that disposable portion will be reduced and limited down to the portion he is allowed to distribute. However, there is an exception to this general rule, the concept of statutory portion does not apply to any person who he or his father was born in UK or in most of the?Commonwealth countries as they are allowed to dispose the whole of their estate as to their wishes.
How is the disposable portion being calculated?
The disposable portion of the estate of the testator is calculated as follows:
If the testator has any children or descendants of children at the time of his death, the disposable portion is ? of the of the net value of his estate;
If the testator has no children or descendants of children at the time of his death, but has a surviving spouse or a parent, the disposable portion is ? of the of the net value of his estate;
If the testator has no children, no descendants of children, no surviving spouse or a parent at the time of his death, then the whole of his estate may be distributed according to his will.
How is the statutory portion being distributed?
Firstly the portion of the surviving spouse is calculated. According to section 44 the surviving spouse has the right in any given case to receive a share from the statutory portion which is calculated according to the degree of kinship of the rest of the heirs of the testator. If the testator after his death:
Has children or any descendants of any children who died while the testator was alive, the surviving spouse and any children or descendants of any children will receive equal shares of the statutory portion of the estate.
Has no children or descendants of any children, but has any other relative from the third class of kindred, the portion of the surviving spouse will be ? of the statutory portion of the estate.
Has no children or descendants of any children, or any ascendants or descendants from the third class of kindred, but he has any ascendant or descendant from the 4th class of kindred, the portion of the surviving spouse will be ? of the statutory portion of the estate.
Has no relatives from any of the above mentioned classes, then the portion of the surviving spouse will be the whole of the statutory portion of the estate.
Additionally, the law provides (section 45) that the estate which was received by the testator due to a matrimonial agreement is not included in the calculation of the portion of the surviving spouse.?After the portion of the surviving spouse is being calculated, the rest of the estate will be distributed to the rest of the relatives according to their class of kindred. There are four classes of kindred. The first class includes the children of the testator, descendants of any deceased children who were alive at the time of the death of the testator. Descendants of any living children at the time of the death of the testator are not allowed to receive any share of the portion.?The children of the testator will receive equal portions and the descendants of the deceased children will receive the share of those children in stripes. For example, if the testator had three children, two of which were alive at the time of his death but all three had two children, then the two living children will get 1/3 each and the two children of the dead child will get 1/6 each. The second class includes the parents of the testator or, if the parents are no longer alive then, any closest ascendant who is alive at the time of the death of the testator, or the siblings (half brothers and sisters are also included in this class) or the descendants of the deceased siblings of the testator. The members of this class will receive equal shares of the portion except that the half brothers and sisters will receive half of the share which the siblings will receive. The descendant of the deceased siblings will receive the share of those siblings in stripes. The third class includes the nearest ancestors of the testator who are alive at the time of his death, i.e. great grandparents, uncle, nephew, great grandchildren. If there are ancestors of the same level of relation from both sides, the mother and the father side of the testator, each side will receive half of the portion of the estate and if there is more than 1 ancestor in each side, they will divide the half portion among them in equal shares. The fourth class includes the nearest relatives of the testator who are alive at the time of the testator?s death up to the grade of relation of the members of the sixth class (i.e. first cousin, great great grandparents, siblings of grandparents). It should be noted that the members of one class of kindred cancel out the members of the next class from having a right to receive share of the statutory portion.
Who has the legal capacity to make a will?
In order for an individual to have the legal capacity to make a will he must be of sound mind and be over 18 years old. Both criteria must be satisfied otherwise the will is considered to be void. The concept ?sound mind? has a broad meaning; it does not only include people that suffer from a mental disease but also people whose mental health has been affected by advanced age or otherwise. It must be proved that at the material time of the execution of the will, the testator is in a state where he undoubtedly perceives what kind of legal document he signs and what kinds of rights are being derived from that document. According to the Court, the material time that will be taken into consideration is the date of the execution of the will. The mental status of the testator before or after the execution of the will is irrelevant. A will may be valid even if the testator was not of sound mind before or after the execution of the will. In practice, it is advisable for medical evidence to be obtained as to the mental state of the testator in order to eliminate any possible doubts for his mental state. In cases though where the mental state of the testator is being questioned; it would also be advisable for his doctor to sign as one of the witnesses of the will and to swear an affidavit at the Court by which he is stating that the will has been executed before him and that the testator was of sound of mind.
What kind of formalities must be complied in order for the will to be valid?
A will must be in full compliance with the following five formalities otherwise is considered to be void: ??The will must be signed at the end or at the bottom by the testator. In cases where the testator is unable to sign, he may instruct another person to sign on his behalf at ?his presence. Also, if the testator is illiterate, then instead of signing the will, he may put his mark or stamp, i.e. fingers prints.
The signature of the testator must be witnessed by at least two witnesses who must be present at the time the testator signs the will. It is of great significance that the witnesses have seen the signature of the testator. Even if the will is already signed, the testator is stating that the signature is his and he makes a request to the witnesses to sign as witnesses is considered to be an adequate recognition. It should be noted that the witnesses must be of sound mind and over 18 years old and also, if they are illiterate, they may put their mark or stamp instead of their signature.
??The witnesses must sign the will at the presence of the testator and of one another.
It must be noted that the witnesses do not affirm the content of the will, but they affirm that the testator has signed the will in their presence and that the testator has signed a legal document namely a ?Will?.
If the will consists of more than one sheet of paper, then every sheet must be initialized and the final page signed by both the witnesses and the testator.
The will must be in writing.
All the above mentioned formalities are compulsory and must be strictly followed. The sole intention of the testator to distribute his estate according to his wishes stated in his will is not sufficient for a will to be valid if at least one of the above-mentioned formalities is not complied with. If the will or part of the will is the result of duress, fraud or misrepresentation then it is considered to be void. The burden of proof lies on the hands of the person who alleged the will was not the result of the free will of the testator and must proof it on the balance of probabilities.
Can a will be revoked?
A will may be revoked by one of the following ways:
??To draft a subsequent will where it is clearly stated that the previous will is being revoked. If the subsequent will does not comply with the formalities, is considered to be void and the previous remains in force.
A subsequent will which revokes only part of the previous will that is not compatible with the former one.??
If the will is teared, burned or destroyed by the testator or by any other person upon the request of the testator. However, if the will destroyed by any other person without the testator?s request, then the will is not considered to be revoked.
??If the testator gets married or has children after the execution of the will, the will is considered to be revoked unless he drew up his will considering the possibility of such a marriage or the birth of his children. Additionally, if the testator?s marriage has been dissolved, his will be revoked unless he has reviewed or re executed the will.
A will or part of the will which has been revoked may be revived with the remaking of the will. It is vital for the intention of the testator for the remaking of the will to be present and?the revived will to be in full compliance with the formalities and to be in the same form as the previous one.
Are there any tax obligations?
The testator?s will is free of any inheritance tax as the Estate Duty (Amending) Law 2000 has been abolished regarding any person who passed away after the 1st of January of?2000.

A person familiar with the inauguration tells The Associated Press that the pop star will perform at Tuesday's ball for President Barack Obama's staffers. The source spoke on condition of anonymity because that person wasn't authorized to publicly reveal the information.
The staff ball is typically a private affair. During the last inauguration festivities, Jay-Z reportedly performed for that event.
According to one attendee, Jay-Z rapped a riff on one of his hit songs, "99 Problems but George Bush Ain't One," to the delight of the throngs of young staffers who worked to elect Obama in 2008.

At the start of President Barack Obama's second term, the Republican Party finds itself lacking both a standard-bearer and a singular vision. No shortage of Republicans are jockeying to fill that leadership vacuum, and the divisions between the establishment and insurgent wings of the parties persist.
It's a far different place than where Republicans were four years ago. They vigorously opposed Obama's first-term agenda and were energized by tea party voters who responded in force to the president's health care agenda. That helped the GOP retake the House in 2010. But, two years later, Mitt Romney, a former Massachusetts governor, failed to mobilize all parts of the party's base.
So now, the GOP is trying to figure out how to recover from Romney's defeat and from popular vote losses in five of the past six presidential elections. It's also trying to determine how to cobble together a broader coalition of voters, and specifically attract minority voters who are more heavily than before favoring Democrats over Republicans. And it hopes to tap into a new generation of leaders to help rebuild.
As Republicans chart a new course, they have history on their side. The president's party tends to lose seats in Congress during the midterm elections of a second term. And the same party has won the White House in three consecutive elections only once in the past 60 years.

A 15-year-old boy has been charged in the shooting deaths of two adults and three children in southwest Albuquerque, N.M., local police say, according to local news media.
The unidentified male juvenile was arrested and charged with two counts of murder and three counts of child abuse resulting in death, KOB-TV 4 reported.
Bernalillo County sheriff's deputies responded to a private residence in the city's South Valley area around 9:15 p.m. Saturday. The bodies of a man, a woman, two girls and a boy were discovered in the home, each riddled with multiple gunshot wounds, reports said.
Police found several weapons at the scene of the crime,?including a semi-automatic military-style rifle, according to KOB-TV.?
The investigation is ongoing. The identities of the teenage suspect and five victims have not yet been released.
The former chief of the U.S. Anti-Doping Agency says a representative of Lance Armstrong's offered the agency a donation in the range of $200,000 to $250,000 in 2004 and the agency immediately rejected it.
Terry Madden, who led USADA from 2000-07, corroborated a story current CEO Travis Tygart told in an interview earlier this month.
In his interview with Oprah Winfrey on Friday, Armstrong said no one in his camp made such an offer.
"Nobody," Armstrong said. "Certainly I had no knowledge of that. But I've asked around. Did anybody? Not true."
Madden countered that, saying the Armstrong representative called Tygart ? then USADA's general counsel ? who came to Madden's office with the proposal.
"Then, 10 seconds later, because of our ethics, I told Travis to turn it down," Madden said. "We called back that representative and gave them our decision immediately."
Madden said he could not name the Armstrong representative because of a pending federal whistleblower lawsuit against the cyclist.
He called the offer "very, very strange and it was such an easy decision for us."
"It's very clear, we cannot accept gifts from people we're either currently testing or would be testing in the future," he said.
Asked why he thought Armstrong disputed the offer, Madden said, "It's just another personal attack on Travis and USADA."

WASHINGTON (AP) ? Consider it the first fact check of a Barack Obama campaign pledge for his second term: Will he, or Mother Nature, deliver on promised warmer Inauguration Day weather?
It's shaping up as a close call.
In September, while campaigning in Colorado, Obama was talking to a potential voter who mentioned he had been one of the hundreds of thousands of people outdoors at Obama's bone-chilling first inaugural in 2009, when the noontime temperature was 28 degrees. Obama promised: "This one is going to be warmer."
Scientifically, the president doesn't have control of day-to-day weather. While his policies can lessen or worsen future projected global warming on a large scale, they cannot do anything about Washington's daily temperature on Jan. 21.
Still, it's a promise that for a long time looked close to a sure thing. The history of local weather was on Obama's side.
On average, the normal high is 43 degrees and the normal low is 28, but that's just around dawn. There have been 19 traditional January inaugurations and only two were colder. Ronald Reagan's second in 1985 was a frigid 7 with subzero wind chills and John F. Kennedy's in 1961 was a snow-covered 22. Jimmy Carter's 1977 inauguration also was 28.
Then there was the general warming trend Washington had been stuck in. The last time the nation's capital stayed below freezing all day was Jan. 22, 2011. The city has gone a record 700-plus days since it had 2 inches or more of snow.
An Arctic cold front looks to be racing toward the mid-Atlantic, so it will be cooler than normal on Monday, but probably not cooler than 2009, said Nikole Listemaa, a senior forecaster at the National Weather Service office in Sterling, Va., that oversees forecasts for the capital area.
Look for highs around 40 degrees with noon temperatures in the mid- to upper 30s, Listemaa said Saturday. That would keep Obama's pledge.
There's also a 30 percent chance of light snow showers for Monday. But the Arctic cold front won't arrive until Monday night into Tuesday, Listemaa added.
Extreme cold on Inauguration Day, folklore says, can be a killer.
In 1841, newly elected president William Henry Harrison stood outside without a coat or hat as he spoke for an hour and 40 minutes. He caught a cold that day and it became pneumonia and he died one month after being sworn in.
Twelve years later, outgoing first lady Abigail Fillmore got sick from sitting outside on a cold wet platform as Franklin Pierce was inaugurated and she died of pneumonia at the end of the month. Doctors now know that pneumonia is caused by germs, but prolonged exposure to extreme cold weather may hurt the airways and make someone more susceptible to getting sick.
There's one thing Washington's history shows. Bad weather generally creates bad traffic jams.
Kennedy found that out in his 1961 inauguration when 8 inches of snow fell overnight and crippled the city for what at that time was Washington's worst traffic jam. Thousands of cars were abandoned in the snow.
